Forliget af 25. september 2019 mellem Konkurrencemyndighederne (Konkurrenceankenævnet, Konkurrencerådet og Konkurrence- og Forbrugerstyrelsen) og Ørsted Bioenergy & Thermal Power (Elsam) i Elsam II-sagen har den betydning, at Konkurrenceankenævnets kendelse af 14. november 2006 er ændret således, at kendelsens punkt 11 (s. 299), første afsnit, har følgende gældende ordlyd:

"Ankenævnet tiltræder, at Elsam i perioden 1. juli 2003 til 31. december 2004 indtog en dominerende position på et marked for engrossalg af fysisk el i Vestdanmark. Ankenævnet finder således, at Konkurrencerådet med den påklagede afgørelses omfattende og dybtgående undersøgelser og analyser i hvert fald har påvist, at Elsam i perioden havde mulighed for i et vist omfang at styre prisdannelsen på det nævnte marked."

Dette betyder, at den oprindelige kendelses punkt 11, første afsnit, første punktum, sidste led ("… og at Elsam har misbrugt denne stilling."), samt andet punktum, sidste led ("… og i et vist omfang gjorde det i strid med konkurrencelovens § 11, stk. 1, jf. stk. 3, nr. 1/EF-traktatens artikel 82, stk. 1, jf. stk. 2, litra a.") udgår.
