Forlig i Elsam II-sagen

Konkurrencemyndighederne har indgået forlig med Ørsted i den såkaldte Elsam II-sag. Forliget indebærer, at parterne erkender, at det ikke med den fornødne sikkerhed er påvist, at Elsam har misbrugt sin dominerende stilling til at tage urimeligt høje priser i perioden juli 2003 til december 2004.

Forliget har den betydning, at Konkurrenceankenævnets kendelse af 14. november 2006 er ændret således, at kendelsens punkt 11 (s. 299), første afsnit, har følgende gældende ordlyd:

"Ankenævnet tiltræder, at Elsam i perioden 1. juli 2003 til 31. december 2004 indtog en dominerende position på et marked for engrossalg af fysisk el i Vestdanmark. Ankenævnet finder således, at Konkurrencerådet med den påklagede afgørelses omfattende og dybtgående undersøgelser og analyser i hvert fald har påvist, at Elsam i perioden havde mulighed for i et vist omfang at styre prisdannelsen på det nævnte marked."
